Copyright & Takedowns
Spirit & Cask respects the intellectual property rights of others. Our photography is published under license, with permission, or from sources that permit republication with attribution, and our text is original editorial work. If you believe material on this site infringes your copyright, this page sets out how to tell us and how we respond.
Designated contact
The designated contact for copyright matters is being finalized by the publisher. Until it is confirmed, send copyright notices through the contact channel listed on our Contact page, with the subject line "DMCA". Complete notices receive the handling described below.
What a takedown notice must include
Under 17 U.S.C. 512(c)(3), a complete notice contains:
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material claimed to be infringing and where it appears on our site (the full URL).
- Your name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Your physical or electronic signature.
Takedown procedure
We review complete notices promptly. Material found to infringe is removed, or access to it disabled, without undue delay, and we may notify the party that provided the material. We keep a record of notices received. Contributors who repeatedly provide infringing material are treated as repeat infringers: their material is removed and their access may be terminated.
Counter-notice
If material you provided was removed or disabled following a copyright notice and you believe the removal resulted from a mistake or misidentification, you may send a counter-notice to the same address, including the information required by 17 U.S.C. 512(g)(3). Misrepresentations in either direction carry legal consequences, so consider independent legal advice before filing.
Photography
Photographs on this site are published under license, with permission, or from sources that permit republication with attribution, and are credited on the page where they appear. If you are a photographer or rights holder who believes a credit is wrong or a photograph misused, write to us through the contact channel listed on our Contact page and we will investigate and correct promptly.
